Terms of Use
1. Introduction
These Terms of Use (“Terms”) govern your access to and use of the Moviegen mobile application (“App”), including all features, content, and services offered by Moviegen Inc. (“we,” “us,” or “our”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
2. Eligibility
You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Description of Service
Moviegen is an application that enables users to generate videos, images, and motion content from text prompts or uploaded images. The App operates on a credit-based system where credits are consumed for each generation.
We reserve the right to modify, suspend, or discontinue any part of the service at any time without prior notice.
4. Account and Registration
4.1 Account Creation
You may create an account using Apple ID or Google authentication. You are responsible for maintaining the confidentiality of your account credentials.
4.2 Account Responsibility
You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use.
5. Credit System
5.1 Credit Usage
Credits are consumed when you generate videos, images, or motion content. Credits cannot be transferred between accounts and have no monetary value outside the App.
5.2 Purchases
Credit purchases are final. Refunds are not provided once credits have been purchased or used. Please review your purchase before completing the transaction.
5.3 Unused Credits
Unused credits remain in your account until used. Upon account deletion, any unused credits are forfeited and cannot be recovered.
6. Acceptable Use
You agree to use the App only for lawful purposes and in accordance with these Terms.
- ✕Do not use the App to create content that infringes intellectual property rights, defames others, or violates any applicable law.
- ✕Do not upload or generate content that is illegal, harmful, threatening, abusive, harassing, or otherwise objectionable.
- ✕Do not generate sexually explicit, pornographic, or adult-only videos, images, or motion content of any kind.
- ✕Do not generate content that constitutes or promotes propaganda, incites hatred, or is intended to radicalize or manipulate individuals or groups.
- ✕Do not generate any content that involves, depicts, exploits, or endangers minors in any way, including but not limited to child sexual abuse material (CSAM). Such content is strictly prohibited. In such cases, any and all information requested by the relevant authorities will be fully provided.
- ✕Do not attempt to circumvent the credit system, reverse engineer the App, or use automated means to access the service without permission.
- ✕Do not share your account credentials or allow others to use your account.
In cases of violations involving illegal content, all available information related to the incident will be fully and transparently disclosed to the relevant legal authorities and law enforcement agencies upon request or as required by applicable law.
You are solely responsible for all content you generate through the App. Any illegal activity conducted through your account will be directly associated with the email address linked to that account.
7. Content Moderation
Note
All content you submit or generate through the App is subject to automated moderation. You are solely and entirely responsible for any content you upload or generate. Violation of these moderation standards may result in immediate account suspension or termination.
7.1 Automated Moderation System
The App uses OpenAI’s content moderation API to automatically evaluate all text prompts and uploaded images before processing. Prompts or images flagged as policy-violating are rejected and will not be processed.
In addition to moderation, we apply negative prompt filtering at the generation level to further prevent the creation of harmful, explicit, or policy-violating content.
7.2 Third-Party Infrastructure
Moviegen does not operate its own AI model infrastructure. All generation services including video, image, and motion generation are provided exclusively by Runware and Fal.ai. We do not host, train, or maintain any AI models.
Generated and uploaded content is processed on the servers of Runware and Fal.ai and is subject to their respective privacy and data policies. Moviegen may retain operational metadata such as prompt history, usage logs, and request identifiers for service operation, security monitoring, abuse prevention, and legal compliance purposes.
Moviegen does not permanently store the images you upload as input. Input images are transmitted directly to Runware’s or Fal.ai’s infrastructure for processing. Transient copies may briefly exist in network transmission buffers or diagnostic systems during this process and are not retained beyond what is technically necessary for service delivery.
7.3 Content Visibility & Privacy Controls
By default, videos and other content you generate through the App are private and visible only to you. You may choose to make content publicly visible on your profile by explicitly enabling this option in your privacy settings within the App.
Users under 18 years of age are strongly encouraged to keep their generated content set to private. Minors should not enable public visibility for their content without parental awareness and consent. We reserve the right to restrict public visibility for accounts we have reason to believe belong to minors.
You are responsible for all content you upload and generate using the App. Moviegen employs automated moderation systems to detect and remove policy-violating content and will act on credible reports of harmful material; however, we cannot guarantee the complete prevention of all objectionable content reaching the platform.
7.4 Content Removal
Moviegen is able to remove content from the platform upon request or upon detection of a policy violation. However, because all content is stored on third-party infrastructure (Runware, Fal.ai), we cannot guarantee immediate or permanent deletion from their systems.
If you wish to request removal of specific content, please contact us through the in-app support feature.
8. Intellectual Property
8.1 Our Rights
The App, including its design, features, logos, and underlying technology, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without our written consent.
8.2 Your Content
You retain ownership of content you upload (e.g., images). By uploading content, you grant us a limited license to process and transmit it to our service providers (such as Runware and Fal.ai) solely for the purpose of providing the service.
8.3 Generated Content
Subject to your compliance with these Terms, you own the videos, images, and motion content you generate using the App. We do not claim ownership of your generated content.
9. Prohibited Content
You may not use the App to generate content that:
- ✕Depicts or promotes violence, hate speech, or discrimination.
- ✕Contains sexually explicit or pornographic material.
- ✕Impersonates another person or entity without permission.
- ✕Violates the rights of minors or exploits vulnerable individuals.
We reserve the right to remove content and suspend or terminate accounts that violate these provisions.
10. Disclaimers
The App and all content are provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
The App uses artificial intelligence to generate videos, images, and motion content. AI-generated content may not always produce the results you desire or expect. We do not accept any liability for the quality, accuracy, suitability, or any other aspect of AI-generated content. Your use of AI-generated content is at your own risk.
11. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
Our total liability for any claims arising from these Terms or your use of the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Moviegen Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the App, your content, or your violation of these Terms.
13. Termination
We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion.
You may request account deletion through the in-app process. Upon deletion, your account data will be removed in accordance with our Privacy Policy.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App. Your continued use of the App after such changes constitutes acceptance of the new Terms.
We encourage you to review these Terms periodically.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
