Terms of Use

1. Introduction

These Terms of Use (“Terms”) govern your access to and use of the Moviegen mobile application (“App”), including all features, content, and services offered by Moviegen Inc. (“we,” “us,” or “our”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Moviegen is an application that enables users to generate videos, images, and motion content from text prompts or uploaded images. The App operates on a credit-based system where credits are consumed for each generation.
We reserve the right to modify, suspend, or discontinue any part of the service at any time without prior notice.

You may create an account using Apple ID or Google authentication. You are responsible for maintaining the confidentiality of your account credentials.

You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use.

Credits are consumed when you generate videos, images, or motion content. Credits cannot be transferred between accounts and have no monetary value outside the App.

Credit purchases are final. Refunds are not provided once credits have been purchased or used. Please review your purchase before completing the transaction.

Unused credits remain in your account until used. Upon account deletion, any unused credits are forfeited and cannot be recovered.

You agree to use the App only for lawful purposes and in accordance with these Terms. You must not:
Use the App to create content that infringes intellectual property rights, defames others, or violates any applicable law.
Upload or generate content that is illegal, harmful, threatening, abusive, harassing, or otherwise objectionable.
Attempt to circumvent the credit system, reverse engineer the App, or use automated means to access the service without permission.
Share your account credentials or allow others to use your account.

The App, including its design, features, logos, and underlying technology, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without our written consent.

You retain ownership of content you upload (e.g., images). By uploading content, you grant us a limited license to process and transmit it to our service providers (such as Runware API) solely for the purpose of providing the service.

Subject to your compliance with these Terms, you own the videos, images, and motion content you generate using the App. We do not claim ownership of your generated content.

You may not use the App to generate content that:
Depicts or promotes violence, hate speech, or discrimination.
Contains sexually explicit or pornographic material.
Impersonates another person or entity without permission.
Violates the rights of minors or exploits vulnerable individuals.
We reserve the right to remove content and suspend or terminate accounts that violate these provisions.

The App and all content are provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
Generated content may not always meet your expectations. We are not responsible for the accuracy, quality, or suitability of generated content for any particular purpose.

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
Our total liability for any claims arising from these Terms or your use of the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Moviegen Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the App, your content, or your violation of these Terms.

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion.
You may request account deletion through the in-app process. Upon deletion, your account data will be removed in accordance with our Privacy Policy.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App. Your continued use of the App after such changes constitutes acceptance of the new Terms.
We encourage you to review these Terms periodically.

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

If you have questions about these Terms of Use, please contact us through the in-app support feature. We will respond within 30 days.

By using our App, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
